1 Acceptance of Terms

By accessing or using the website at www.upmarketbijoux.com(the "Site"), purchasing any item, or submitting items through our consignment portal, you agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue using our services immediately.

2Nature of Goods & Authenticity

Upmarket Bijoux specializes in curated estate fine jewelry (e.g., 14k gold, sterling silver), antique porcelain and decorative arts, designer accessories, and rare modern collectibles (such as Pop Mart Labubu figures).

A. Vintage & Pre-Owned Characteristics

Unless explicitly described as "Brand New" or "New in Box," our catalog pieces are vintage, antique, or pre-owned. As such, they may show expected age-appropriate wear, subtle patina, faint hairline markings, or gentle hallmarks of previous loving stewardship. We photograph every piece under studio lighting and provide detailed condition notes. Buyers are encouraged to review all photographs and descriptions prior to purchase.

B. Authenticity Guarantee

We take pride in rigorous item inspection. Precious metals and gemstones are tested using industry-standard gemological and metallurgical instruments, and brand hallmarks (e.g., Pandora, Tiffany, Pop Mart) are verified against official manufacturing references. Every piece is guaranteed authentic as described.

3Pricing, Availability & Orders

• One-of-a-Kind Inventory: Because many of our estate and antique treasures are unique, single-inventory items, availability is subject to prior sale. In the rare event an item is purchased simultaneously across platforms, orders will be fulfilled chronologically and any unfulfillable order will receive an immediate full refund.
• Errors & Inaccuracies: While we endeavor to ensure all pricing, weights, dimensions, and specifications are accurate, clerical errors may occasionally occur. Upmarket Bijoux reserves the right to correct any typographical errors, inaccuracies, or omissions, and to cancel or refuse any orders placed based on inaccurate information.
• Direct Offers & Negotiations: Any price offers submitted via our inquiry system are non-binding until explicitly agreed upon in writing and finalized with payment.

4Shipping, Insurance & Risk of Loss

We treat each piece with museum-grade care:

• Packaging & Handling: Items are dispatched with secure, protective packaging within 1 to 2 business days of cleared payment.
• Courier & Tracking: Shipments are processed via reputable carriers (USPS Priority, UPS, or FedEx) with tracking numbers provided immediately upon dispatch. High-value jewelry orders require adult signature confirmation upon delivery.
• Insurance & Delivery: All orders are insured for full purchase value during transit until carrier confirmation of delivery to the address provided at checkout.

5Returns & Refunds

We want you to be completely delighted with your acquisition:

• Direct Purchases: For direct website purchases, we offer a 14-day return window from the confirmed delivery date. Items must be returned in their original, unaltered condition with all original packaging, tags, and documentation.
• Third-Party Marketplace Orders: Orders placed via our official eBay storefront, Poshmark closet, or other external platforms are governed by the return policies established on that specific platform.
• Return Shipping: The buyer is responsible for insured return shipping with tracking, unless an item was demonstrably misrepresented in its description.

6 Consignment Program Terms

When submitting items for consignment via our Sell page:

• Title & Ownership: You warrant that you are the sole, lawful owner of all submitted merchandise, that items are free from liens or encumbrances, and that no item is stolen, counterfeit, or illicit.
• Inspection & Valuation: Acceptance into our consignment collection is at our sole professional discretion following physical inspection and authentication.
• Commission & Payouts: Consignment payouts are calculated based on the net proceeds of sale in accordance with our agreed fee tier schedule. Consignors receive prompt disbursement within 7 to 10 business days following the conclusion of any applicable buyer return window.
• Unsold Inventory: If a consigned piece does not sell within the agreed exclusivity window, the consignor may request return of the item, subject to standard return shipping costs.

7 Intellectual Property

All content on the Site—including photographic assets, high-resolution product imagery, editorial copy, branding, Crown iconography, and visual design—is the exclusive intellectual property of Upmarket Bijoux and protected under United States and international copyright and trademark laws. No content may be reproduced, mirrored, or utilized for commercial purposes without our express written permission.

8 Limitation of Liability

To the fullest extent permitted by law, Upmarket Bijoux and its owners, officers, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of our Site, delay in shipping, or reliance upon any material presented. Our maximum cumulative liability for any claim shall not exceed the amount actually paid by you for the specific item in dispute.

9Governing Law & Jurisdiction

These Terms shall be construed and governed in accordance with the laws of the Commonwealth of Massachusetts and the federal laws of the United States of America, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in state or federal courts located within the Commonwealth of Massachusetts.
